These terms are the agreement between you and us for playing the WordJax games, The Golden Rule by WordJax and Glitch by WordJax, in their iPhone and Android apps and on their websites at wordjax.com/goldenrule and wordjax.com/glitch. By playing, you agree to them. Accounts, profiles, groups and the other social features exist only in The Golden Rule. Glitch has no accounts today, so the sections about them don't apply to it. They're written to be read, so please do. Our privacy policy explains what we do with your information.
1. Who you're agreeing with
WordJax is a trade name of Jordan Axelrod, an individual based in Florida, USA. "We" and "us" in these terms means him. You can reach us at jordan@wediorknot.com.
2. Who can play
You need to be at least 13 years old to play either game. If you're under the age of majority where you live, please read these terms with a parent or guardian. By creating an account you confirm you meet the age requirement and that you're allowed to agree to these terms.
3. The games are free
Both games are free to play and paid for by ads. There are no purchases in the app and no subscription. Some things, such as a hint on a daily puzzle, older puzzles in the archive, or a streak repair in Glitch, are offered in return for watching a short video ad, which is always your choice.
Streaks, stats, points, hat tricks, milestones and leaderboard places are there for fun. They aren't money, they aren't property, they have no cash value and they can't be sold or traded. We may change how they're counted, fix them when something goes wrong, or reset them if they were earned by cheating.
4. Your account (The Golden Rule)
You don't need an account to play. Signing in with Apple or Google lets you build a profile, follow friends, see a feed of highlights, and join groups. You're responsible for what happens under your account, so keep your Apple or Google login safe. One account per person, please, and don't sell, share or transfer your account or your handle.
If you play without an account, or play Glitch, your recovery code in Settings is the only way to move your streak to another phone. Keep it somewhere safe and don't share it: anyone with the code can take over that player's history.
5. Handles, names, photos, bios and groups (The Golden Rule)
You're responsible for anything you put in the game: your handle, display name, photo, bio, and the names of groups you create. None of them may:
- pretend to be someone else, including another player, a real person, a brand, or us;
- harass, bully, threaten or target another person;
- be sexual or show nudity;
- attack people for their race, ethnicity, national origin, religion, disability, sex, sexual orientation, gender identity, age or any similar trait;
- promote violence, self-harm, illegal drugs or anything illegal;
- be spam, advertising, or a link or contact detail meant to pull people somewhere else;
- share someone else's private information;
- use material you don't have the right to use, such as a photo of someone who hasn't agreed to it, or someone else's artwork or logo.
In both games, you also agree not to cheat, not to use bots or scripts to play or to create accounts, not to scrape or copy the puzzles, the word lists or the daily schedule, not to try to get into parts of the game or our servers that aren't meant for you, and not to interfere with the game for anyone else.
6. Blocking, reporting and moderation (The Golden Rule)
You can block or report any player from their profile. A block hides you from each other. A report comes to us with the reason you chose. Some words aren't allowed in handles, names, bios or group names, and some handles are reserved (for example ones that look official, like "support" or "admin", or that use our game names).
We review reports and may, at our discretion and without notice: remove or change any handle, name, photo, bio or group name; take back a handle that breaks these terms or that impersonates someone; close a group; or suspend or end an account that breaks these terms or puts other players at risk. We aren't able to check everything people post, and we're not responsible for what other players put in the game, but we do act on reports. If you think we got a decision wrong, email us and we'll look again.
7. What you let us do with your content
Your content stays yours. To run the game, you give us a non-exclusive, worldwide, royalty-free licence to store, copy, resize and display your handle, display name, photo, bio and group names, in the app, to the players who are allowed to see them, for as long as they're in the game. The licence ends when you delete the content or your account, except that we may keep what the privacy policy says we keep, such as the handle in a report another player made about you.
8. Our games and our content
The Golden Rule, Glitch, WordJax, the games' rules and design, the puzzles, the hidden rules, our selection of words and daily schedule, the artwork, the text and the software all belong to us or to the people who licensed them to us. We give you a personal, non-exclusive, non-transferable licence to use the app and website for your own non-commercial fun, as long as you follow these terms. You can share your results using the share button; please don't republish the puzzles or their answers in bulk.
9. Ads and other services
The ads you see come from Google AdMob and its partners. We don't choose individual ads and we don't endorse what they advertise. If you tap an ad or sign in with Apple or Google, their own terms apply to what happens there.
10. Availability and changes to the game
We'll try to keep the games running and a new daily puzzle ready every day, but we can't promise it will always be available, on time or free of mistakes. We may change, add or remove features, puzzles or ad formats, and we may stop offering a game altogether. If we plan to close a game, we'll try to give reasonable notice in the app.
11. Ending things
You can stop playing whenever you like, and you can delete a Golden Rule account in the app: open Settings, tap Account, then Delete account. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering a game. Sections 3, 7 (for what we're allowed to keep), 8, 12, 13, 14 and 15 continue after your access ends.
12. The games are provided as they are
We make the games with care, but they're provided "as is" and "as available". To the extent the law allows, we don't give any promises beyond those in these terms, including implied promises that a game is fit for a particular purpose, that it will be uninterrupted or error free, or that your streaks and stats will never be lost. Some places don't allow these kinds of exclusions, so some of this section may not apply to you.
13. Limits on our liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost data, lost streaks or lost profits, arising from your use of the game. Our total liability to you for everything related to the games is limited to US$50. The games are free, and that's the reason for this limit.
Nothing in these terms limits liability that the law says can't be limited, such as for fraud, or for death or personal injury caused by negligence.
14. If you break these terms
If someone brings a claim against us because you broke these terms or the law while using the game, for example because of a photo you uploaded, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
15. Law and disputes
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law rules. If we have a disagreement, please email us first. Most things can be fixed that way. If they can't, any court case will be brought in the state or federal courts located in Florida, and you and we agree to those courts' jurisdiction. Either of us may instead use a small claims court if the claim qualifies.
If you're a consumer living outside the US, for example in the EEA or the UK, you keep the protection of the mandatory consumer laws of the country where you live, and you can also bring a claim in your local courts. Nothing in these terms takes away rights you have as a consumer that can't be waived by contract.
16. Terms for the iPhone apps
If you got an app from Apple's App Store, these extra points apply. These terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any warranty that applies, you may notify Apple, and Apple will refund any purchase price (the app is free, so there's none). To the extent the law allows, Apple has no other warranty obligation for the app. We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection claims, and for investigating and defending any claim that the app infringes someone's intellectual property. You confirm that you're not in a country under a US government embargo and not on a US government list of prohibited or restricted parties. You must also follow the App Store's own terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
17. Changes to these terms
We may update these terms as the games change. When we do, we'll change the date at the top of this page. If a change is significant, we'll tell you in the app before it takes effect. If you keep playing after that, the new terms apply. If you don't agree with them, you can stop playing and delete your account.
18. The rest of the legal bits
These terms and the privacy policy are the whole agreement between you and us about the games. If a court finds part of them unenforceable, the rest still applies. If we don't enforce something straight away, we haven't given up the right to enforce it later. You can't transfer these terms to someone else. We may transfer them to a company that takes over the games, for example if WordJax becomes a company.
